| OUR TERMS BOOKING Any reservation must be accompanied by: the payment of the instalment representing 25% of the total amount of the stay (the amount indicated in the description form) The signature of the leasing agreement, the description form, and our general conditions into double specimens. One of which is kept by the tenant.
Every pages must be initialled, the last one signed with the mention "Read and approved". All the documents must be returned maximum 8 days after their reception. We will confirm your reservation only after the reception of the documents. The balance representing 75% of the stay must be regulated the day of arrival.
DATE OF THE STAY The dates are indicated on your contract: It belongs to the owner or to Saison en Provence to receive the tenants for the formalities of arrival. The customer will have to confirm at least 48 hours before the hour of his arrival, near the owner or Saison en Provence. On arrival and beyond 19 h, the owner or the agency is not obliged to insert the customers in the rented house. The tenant will have to spend the night in a hotel at his own charges. If the customer does not present himself to go fixed and the person in charge of the reception is not informed, of the causes of absence, it will lose any rights to the hiring. In this case, the owner or his representative will be able immediately to relet at the best conditions. The starting appointment will have also to be specified by the tenants, 48 H before the effective departure, near the agency or the owner, in order to give the keys and to make the inventory. DURATION OF THE STAY The present hiring having been granted only for seasonal period, the tenant must leave the rented dwelling at the date mentioned in the contract. The tenant will have indicated its residence address in this contract. The hiring could not be extended without the agreement of Saison en Provence or the owner. The taker will not have the right to sub-lease the rented dwelling. PRICE The price, expressed in Euros, get along for the rental period, any expenses are included from June 1st thru Sept. 30th, except excessive use or contrary mention: taxes, fees, heads of water, electricity, gas, maintenance swimming pool. The expenses for telephone, cleaner during the stay and at the departure, are not included. (Some owner offered the departure cleaning) For the winter season, the heads of water, of electricity, gas, heating, are to be regulated at the end of the stay, near the agency or of the owner, on the basis of a real statement of the consumption or a beforehand fixed price. Two exceptions: gas and fuel stored in containers. In this case, a weekly rate is specified on the detailed form. DEPOSIT AND IDENTITY OF THE TENANT A deposit from the tenant is systematically requested on arrival: ordinary check in euros or certified bank's draft for tenant living out of CEE. The amount of this deposit is specified in the contract of reservation. It is given to the person in charge of reception and wording obligatorily in the name of SAISON EN PROVENCE. In the absence of handing-over of the deposit, the entry in the place will be refused. The deposit will be restored at the latest, one month after the departure, except if there were missing degradations, objects, damage or cleaning expenses to be retained. For the phone, the deposit will be refunded after reception of the build and payment. SAISON EN PROVENCE can ask the tenant a copy of his identity card at his arrival. INVENTORY OF FIXTURES The owner is responsible for the quality and the quantity of the interior equipment. It must tallied with the number of people mentioned in the contract and the description form given with the contract. That's why an inventory of fixture is done at your arrival. This document is the only reference in case of litigation. In the event of reporting missing, breaking, defective objects or particular problems, please let the agency or the owner know about it at latest 48 hours after your arrival, no claim could be accommodated after than. Before your departure, another inventory of fixture will be made to compare with the former one. All degradations, disappearances of objects noted at the end of your stay or at the return of the owners, if the inventory of fixtures were made by the agency, will be invoiced and deduced from the deposit. Generally the household linen is not provided. However, the tenant can ask the owner or the agency the provision of household linen, with a supplement. If the tenant needs other services like a cleaning lady or a cook, he could ask the agency or the owner. If the supplies not envisaged in the contract would not be at the place the day of your arrival, or the employee wouldn't present himself in time and place, neither Saison en Provence nor the owner could be held for person in charge , and the tenant couldn't put forward a claim. In the case of litigation between the employee of house and the tenant, he would be the only one to deal of it. NUISANCE Neither the agency, nor the owner could be held for person in charge for irregularities or for problems due to electricity, gas or telephone's services. In the same way, work, building sites, demonstrations of private origin or public authority could be opposed to the agency because disturbing the residents which are rented or not rented via the agency. HOUSEWORK The dwelling will be given in a perfect state of cleanliness and the material in operating state. Some owner may propose a cleaning package. The cost is specified on each rental's detailed sheet. The package is paid directly to the agency on arrival. The occupier is free to accept or to refuse that cleaning package. If accepted, the occupier will not have to clean the house but will have to return the property in a reasonable state, like: clean and set the dishes, clean the kitchen, remove the sheets, set the garden's furniture, put the dust bean in the provided place.... If refused, the occupier will have to return the property in a clean and ordered state before 10am. The tenant will have to return the house in perfect cleanliness and operating condition. If such were not the case, the expenses of cleaning or repair will be invoices to the tenants and regulated on the spot with the owner or the agency. For a good agreement, announce to the agency all the small unfortunate gestures which you could have had, during your stay: break, tasks, degradation on the mattresses, covers, curtains, carpet... The rooms of the rental are to be maintained during the stay. Sheets and kitchen clothes are to be cleaned by the occupiers except on departure day. OBLIGATION OF THE TENANT The tenant must take care of the good maintenance of the house. The dwelling must not be occupied, even for few days, by more people than that stipulated in the contract. In case of non application of this clause, the agency or the owner would have the right to ask for a financial compensation or to require the departure of the people in excess. In the same way, it's strictly forbidden to assemble tents in the garden or to park caravans. The tenant is not allowed to introduce animals in the renting house without authorisation of the agency or the owner. The exceptional events (wedding, reception...) remain subjected to prior agreement of the owner. The tenant will have to abstain to throw in the wash-hand basins, bathtubs, bidets, sinks, laundrettes, water closet, etc...or others objects likely to block the drains. In that case, the tenant will have to reimburse the expenses for repairs. On this subject, because of the difficulties in season to find personnel to repair, or specialized company, the agency declines any responsibility for the delay of intervention. The taker will not be able to claim any reduction of rent if urgent repairs falling to the owner would appear during the stay. At the end of the hiring and before the inventory of exit, every furniture and objects must be replaced at the place they occupied at the time of the entry. The tenant has no authorisation to intervene personally in the machinery of the swimming pool, as well as he‘s not allowed to empty the swimming pool without the agreement of the owner. INSURANCE Concept of civil liability varying from one country to another and the responsibility for our agency not being able to be committed in consequence of accident, losses, flights, fire, damage of water, wounds, the tenant needs to provide a civil liability certificate for renting a house in France. In the case, the tenant's insurance does not provide this type of cover; he will have to subscribe to Saison en Provence's insurance. CANCELLATION'S INSURANCE Saison en Provence proposes an insurance cancellation (justified) and a civil liability on each rental. Its cost is mentioned on the signed contract and its general's condition are sent to the tenant at the booking time. In case of the insurance contract is refused, and at the latest at the first payment or at the full payment, if there is no down-payment, the occupier has to return a certificate of insurance, signed, dated and filled by its own insurance company. Only an insurance agency or company can confirm the guarantees. The certificate must specify the following points: LIMIT OF ENGAGEMENTS OF SAISON EN PROVENCE Starting 1st of January 2005 house owners are obligated by French law to install a security protection around their private swimming pool (Loi 2003-9 du 3 janvier 2003 - J.O du 4 page 278). The responsibility for our agency can not be committed in consequence of an owner's fault concerning the swimming pool protection law by the way all the details about the swimming pool in the renting house are in the description form. The description of our hiring like all the data elements appearing in our various documents and contracts, are provided in good faith on the basis of the indications given by the owners and engages only their responsibility. The indications relating to the situation, nature, and the installation of the buildings are the exact transcription of the information provided by the owner, who certifies that the buildings will be in a perfect state of installation and cleanliness for the arrived of its tenant. Saison en Provence cannot be held responsible for a fault of the owner on this subject. The responsibility for the agency could not also be committed if modifications affecting the rented place or its environment would not have been brought to its attention by the owner at the date of reservation or would intervene between the moment of this one and the entry in the places of the tenant. In the present hiring, the role of marketing of the agency being limited to that of intermediary between the parts, its responsibility can't be committed because of the owner or the tenant. CANCELLATION BECAUSE OF THE TENANT It can happen that the tenant must cancel his coming; in that case his phone cancellation must be confirmed by letter before the beginning of the stay, the post office's date will be taken. In case of cancellation, the customer will be retained: more than 45 days before your arrival: 25% of the total amount of the stay + 80€ for file charges; between 44 and 31 days before the beginning of the stay: 30% of the total amount and file charges between 30 and 21 days before your arrival : 40% of the total amount + file charges between 20 and 8 days before the beginning of the stay: 50% of the total amount and file charges; between 7 and 2 days before your arrival : 75% of the total amount of the stay + file charges; less than 2 days before the date of your arrival, the total amount of your stay will be retained.
Any interrupted or shorten stay, or any not consumed service, because of the tenant, for any reasons that is, does not give the right to any refunding. (see "INSURANCE" article, in case of cancellation) CLAIM The possible complaints concerning the rented dwelling will have to be formulated in the following 48h after the entry in the house, by registered letter, accompanied of proofs, and to be addressed at the agency. The agency will write out a reclamation report. After this delay, complaints could not be taken in account and no refunding will be possible. In case of dispute, the competent courthouse will be the one of the district where the rented houses are located in. Saison en Provence is always available for any details of less importance.
